Mumbai Court Sentences Homoeopathic Doctor for Medical Negligence

Background of the Case

A Panvel court in Mumbai has convicted a homoeopathic doctor for medical negligence resulting in a patient’s death in 2016. The court sentenced the doctor to three years of rigorous imprisonment and imposed a fine of Rs 1.10 lakh. The doctor, who possessed a Bachelor of Homoeopathic Medicine and Surgery (BHMS) degree, was found guilty of administering an allopathic injection without the necessary authorization.

Legal Charges and Court Observations

The 52-year-old doctor faced charges under Section 304A of the Indian Penal Code for causing death due to negligence and Section 33 of the Maharashtra Medical Practitioner Act, 1961. The court noted that while the doctor may not have intended to cause harm, his actions revealed a significant lack of competence and poor judgment. Additional Sessions Judge Dinesh E Kothalikar stated, “It is proved beyond reasonable doubt that the accused was not authorized to practice allopathy… his act exhibited a gross lack of competence and inaction and wanton indifference to the safety of the deceased.”

Incident Details

The incident occurred on November 10, 2016, when the patient, suffering from shivering and fever, sought treatment from the accused doctor. Family members reported that the doctor administered an injection that led to an infection. As the patient’s condition worsened, the family sought treatment at three other hospitals over the following days. Tragically, the patient passed away on November 29, 2016, while still undergoing treatment.

Investigation and Findings

Following the patient’s death, the family lodged a complaint with the Vashi police, alleging negligence. As part of the investigation, medical experts were consulted. The civil surgeon of Alibaug stated that the doctor should have completed a course on Community Medical Service and Essential Drugs, and emphasized that the injection should have been sterilized prior to administration.

During the investigation, the accused claimed he had properly sterilized the injection but could not explain the complications that arose. The investigation revealed that the doctor lacked the necessary certification to administer allopathic injections, yet he proceeded to do so.

Trial and Verdict

During the trial, testimonies from other doctors who treated the patient after the accused were presented. The accused argued that there was no definitive evidence linking him to the administration of the injection, and therefore, he could not be held responsible for the death. However, the court determined that the evidence demonstrated the accused had administered the injection without proper care, which led to the patient’s health deterioration and eventual death.

The court ordered that the fine imposed on the doctor be paid to the victim’s mother and instructed the District Legal Services Authority in Raigad to pursue additional compensation for the family.
