Kolkata Pediatricians Accused of Medical Negligence

Incident Overview

Two pediatricians based in Kolkata face allegations of medical negligence after failing to perform a physical examination on a three-month-old infant. The treatment was conducted exclusively through telephonic consultations. Tragically, the child passed away shortly after being taken to the hospital. It has been reported that emergency protocols were not followed at the hospital, and one of the doctors allegedly issued the death certificate on personal letterhead.

In response to these events, the father of the deceased child has filed a consumer complaint with the District Consumer Disputes Redressal Commission (DCDRC), Kolkata III (South). The commission has accepted the complaint and has instructed that notices be issued to the involved doctors. The commission noted in its order dated January 15, 2026, that the complainant’s infant son developed a high fever on the night of December 31, 2023. Despite nearly 18 hours of telephonic consultations without a physical examination, the first pediatrician discouraged the father from taking the child to the hospital.

The commission stated, “Going through the materials before us, we are of the opinion that there are materials for admitting the complaint. Fix 11/2/2026 for S.R., appearance and for filing written version. Complainant is directed to take step for serving notice upon the O.P.”

Case Background

The complaint outlines that the child, born on September 29, 2023, at Neotia Bhagirathi Woman and Child Care Centre, was healthy and free of medical complications until he developed a high fever on December 31. Following this, the pediatrician was contacted, and the child’s mother was instructed to administer oral “Sumol” drops. The dosage was adjusted based on the child’s weight, but the child’s condition did not improve.

Further Developments

Despite the mother’s concerns and repeated inquiries about taking the child to the hospital, the pediatricians advised against it, stating that there was no need for hospitalization. Another doctor was also consulted and suggested increasing the dosage of the medication. After administering the increased dosage, the child’s condition deteriorated, leading to a cold and motionlessness. When finally taken to the hospital, the child was pronounced dead upon examination.

Next Steps in the Legal Process

The next hearing for the case is scheduled for February 11, 2026. The commission reiterated its stance on the admissibility of the complaint, directing necessary steps for serving notice to the opposing parties.
