## Telangana High Court Orders Resolution of Pension Benefits for Retired Doctor

### Background of the Case
Hyderabad: The Telangana High Court has recently granted relief to Dr. Kumar, an 80-year-old retired assistant civil surgeon, by ordering the State Department of Health, Medical and Family Welfare to address his representation regarding pensionary benefits within an eight-week deadline.

### The Petitioner’s Plea
Dr. Kumar filed a plea seeking the court’s intervention to annul the State Government’s punitive actions, which included withholding his gratuity and imposing a 100 percent pension cut in 2008, two years post-retirement. This order was issued despite the doctor’s acquittal in an Anti-Corruption Bureau (ACB) case.

### Ongoing Legal Struggle
For the past 17 years, Dr. Kumar has been fighting for his rights to pensionary benefits. He has requested the court to compel the Telangana Government to release all withheld retirement benefits immediately, along with interest.

### Case Details
According to a recent media report by the Indian Express, Dr. Kumar retired as an assistant civil surgeon on November 30, 2006. He was facing a criminal case initiated by the ACB in 2001 and was initially convicted by a trial court on May 2, 2007. Based on this conviction, the Telangana Government issued Government Order Rt 142 on February 4, 2008, imposing a severe penalty of a 100 percent pension cut and permanently withholding his gratuity amount of ₹1,35,788.

### Legal Arguments
In his plea, Dr. Kumar sought a Writ of Mandamus to overturn the 2008 Government Order and directed the State Government authorities to release his full pension, including arrears from December 1, 2006, along with the gratuity amount and restoration of other post-retirement entitlements, such as medical reimbursement.

The petitioner’s counsel, Deepak Mishra, highlighted that the Telangana High Court, in a judgment dated July 22, 2024, acquitted Dr. Kumar of all charges, emphasizing that the prosecution failed to prove the demand and acceptance of the alleged bribe.

### Continued Financial Distress
Despite the judicial acquittal that cleared Dr. Kumar’s name, he alleged that the department continued to act on the decade-old Government Order, arbitrarily withholding his final retirement benefits. This has led to significant financial distress for the retired doctor.
