Thane Court Sentences Man for Assault and Robbery of Doctor

A Thane court has delivered a significant verdict, sentencing a man to seven years of rigorous imprisonment for the assault and robbery of a female doctor in 2021. Details of the Incident
The incident took place on January 3, 2021, when the accused approached the doctor’s clinic in the Bhayander area of Thane district, Maharashtra. He claimed to be seeking information about an RT-PCR test. After being asked to wait, he became agitated and left, only to return later to violently attack the doctor.
Nature of the Attack
During the assault, the perpetrator struck the doctor multiple times on the head with an iron hammer. While she lay injured and bleeding, he stole her gold chain, a ring, a mobile phone, and ₹5,000 in cash. The doctor sustained serious injuries, including an acute small hyperdense right frontal subdural hemorrhage.
Legal Proceedings
Additional Public Prosecutor R P Patil presented the charges against the accused, which included house trespass with intent to cause harm and robbery with a deadly weapon, as per the Indian Penal Code. The accused was also convicted under the Prevention of Violence Against Doctors, Medical Professionals and Medical Institutions Act, 2019.
Court’s Observations
The court remarked that the injuries inflicted on the complainant constituted “grievous hurt.” It acknowledged that “subdural hemorrhage, even if described as ‘small’ in the CT scan report, is a serious medical condition that can be fatal if not treated promptly,” indicating a significant risk to the complainant’s life.
Significance of the Ruling
The court emphasized that the Prevention of Violence Against Doctors, Medical Professionals and Medical Institutions Act, 2019, was enacted to provide enhanced protections and stricter penalties for violent acts against medical professionals. This case serves as an illustration of the type of violence the Act aims to prevent.
Sentencing and Compensation
In its sentencing, the court stressed the need for exemplary punishment to ensure justice for the victim and deter similar offenses in the future. It ordered that ₹10,000 from the total fine be allocated to the doctor as compensation for her physical and emotional trauma, medical expenses, and loss of income during her recovery.
Prosecution’s Evidence
To support the charges against the accused, a total of 14 prosecution witnesses were examined during the legal proceedings, as reported by PTI.
